What is the Temporary Foreign Worker Program

The Temporary Foreign Worker Program (TFWP) allows Canadian employers to hire foreign workers when qualified Canadians and permanent residents are not available. The program is administered by Employment and Social Development Canada (ESDC) and IRCC. Employers typically need a positive Labour Market Impact Assessment (LMIA) before hiring through the TFWP.

TFWP streams include high-wage and low-wage positions, the Global Talent Stream for skilled workers, agricultural workers, caregivers, and other occupation-specific categories. Each stream has different recruitment, wage, and duration requirements.

Employers who hire TFWs must comply with program conditions: wages, working conditions, and accommodation must match what was offered in the LMIA. ESDC conducts inspections to verify compliance. Non-compliance can result in penalties, bans from the program, and other consequences.
