What is Employer Compliance
When employers hire temporary foreign workers through a positive LMIA, they enter into obligations with Employment and Social Development Canada (ESDC). Employers must provide wages, working conditions, and accommodation that match what was offered in the LMIA application. These commitments apply for the duration of the worker's employment.
ESDC conducts inspections to verify employer compliance. Inspections can be announced or unannounced and may occur within six years of the worker's start date. Employers must maintain records of employment, payroll, recruitment efforts, accommodation, and other documentation required for compliance verification.
Non-compliance can result in warnings, administrative monetary penalties, bans from hiring temporary foreign workers, and publication of the employer's name on a public list. Proactive compliance management helps employers avoid these outcomes and maintain their ability to hire foreign workers.
